Sons of Silence MC Member Arrested and Released

Rock Island, IL, (August 15, 2021) - A man was released on bond after an Iowa State Trooper found a loaded gun and a small amount of crystal methamphetamine on his motorcycle. Jeffrey Sebree, 51, of Indianapolis, Indiana faces a felony charge of carrying weapons, court documents say.

Shortly after 6:00 p.m. Friday, the trooper stopped Sebree, who was driving a Harley-Davidson near Mile Marker 291 on the eastbound side of Interstate 80. The motorcycle was stopped for going 90 mph in a 70 mph zone.
 


Sebree, who was alone, was wearing a Sons of Silence MC leather vest, “identifying him as being a member of this motorcycle club,” the affidavit says. The trooper asked whether Sebree had a gun. He said he did and that it was locked up on his bike.

“I also observed a red cut-down plastic straw w/ white residue on it sticking out of a pocket on his vest,” the trooper wrote in the affidavit. “Based on my training and experience this item was consistent with snorter straws that (a) drug user will use to snort drugs with.”

The trooper deployed his drug-detection K9, and the dog alerted toward the side of the motorcycle with luggage compartments and a backpack. A probable-cause search produced a “very small personal amount” of crystal methamphetamine and another snorting tube with white residue on it, the affidavit says.

The trooper also found a Kimber .45 caliber handgun with a fully loaded magazine and a round in the chamber.

When the trooper did a background check on Sebree, he discovered Sebree is prohibited from possessing guns. The gun and contraband were seized and submitted into evidence storage, the affidavit says.

Warrants Issued for Suspects in Stabbing

Mandan, North Dakota, USA (September 11, 2020) - Authorities have issued arrest warrants for four men suspected of stabbing a man during an attack on a rival motorcycle club member at a Mandan street dance in July, court records show.

Morton County authorities on Friday filed murder conspiracy charges against Nash Wollan, 48, of Williston; Nicholas Kinsella-Gref, 28, of Mandan; Girard Lee Glaser, 49, of Mandan; and Edward Nuckols, 32, of Mandan. The four also face felony charges for allegedly being part of a criminal street gang, court documents show.


Police say the men are members or aspiring members of the Sons of Silence Motorcycle Club, according to an affidavit. The man who was stabbed stepped in to help a friend, who is a member of the Hells Angels Motorcycle Club, police say. The man was taken to a Bismarck hospital for treatment of eight stab wounds and a collapsed lung. His name was not released.

Court records do not list attorneys for any of the wanted men.

According to the The U.S. Department of Justice: North Dakota has historically been territory claimed by the Sons of Silence, police say. Another motorcycle club in recent years joined the Hells Angels, which Sons of Silence members may have seen as a challenge.

Conspiracy charge dropped before trial

Williston, North Dakota, USA (February 12, 2020) BTN — A felony conspiracy charge was dismissed Tuesday, Feb. 11, the day before the case was set for trial.

Prosecutors asked to have the class C felony conspiracy to commit aggravated assault charge filed against Earl Benjamin Brewer dismissed with prejudice, meaning it cannot be refiled. In the motion to have the charge dropped, Nathan Madden, assistant state’s attorney for Williams County, cited problems with witnesses.

Brewer and a co-defendant, Michael McCreary, were accused in April 2019 of conspiracy after a man was assaulted outside his home in Williston. Police and prosecutors claimed that McCreary assaulted the man at the request of Brewer. McCreary was charged with conspiracy and aggravated assault, both class C felonies.


The request to drop the charges comes days after Madden filed a motion asking for the trials of Brewer and McCreary delayed. In the motion, Madden claimed that multiple witnesses had expressed fear about testifying against Brewer or McCreary.

“The State has been meeting with witnesses in the Brewer and McCreary cases during the week of February 3, 2020,” Madden wrote. “During this week, the State has noticed a change in the attitudes of witnesses expressing safety concerns about testifying in these matters due to threats made against them.”

The request to delay the trial is related to a new criminal charge filed Friday against McCreary. He is accused of trying to convince a witness to change her testimony in the case.

In one instance, McCreary told a witness that damaging information about her, including information about an incident involving the FBI, would become public, Madden wrote. He said he had been unable to track down the exact nature of the incident McCreary was referencing, but said the witness was not a suspect in the matter. Instead, he said, he believed it was an attempt to reveal information the witness had given to the FBI during an investigation into someone else.

Madden said the man who Brewer and McCreary are accused of conspiring to assault had also been threatened. He wrote that the man had gotten a message from a friend who said a third party had told him to relay the message that Brewer should leave the state by Feb. 9.

“Earl Brewer and Michael McCreary are known to have had connections with the Sons of Silence, which is a nationwide motorcycle ‘club,’” Madden wrote. "Given their nationwide presences, they would have sufficient assets to conduct surveillance on (the man) and determine whether he had, in fact, left the state of North Dakota.”

In a response, however, Jeff Nehring, Brewer’s defense attorney, argued Madden offered no evidence to back up his claims.

“Although Mr. Madden has set forth numerous factual allegations in his Motion for Continuance, he has not presented any evidence by way of affidavit or otherwise to support his factual allegations,” Nehring wrote. “Therefore all the allegations made by Mr. Madden should be excluded by the North Dakota Rules of Evidence.”

Nehring also questioned other claims Madden made in his request to delay the trial.

“In regards to (Brewer), Mr. Madden makes a really broad allegation that (Brewer) has nationwide assets to conduct surveillance on (the accuser),” Nehring wrote. “Where is this information coming from? Mr. Madden cites no specifics on where he based his statement upon. Once again. Mr. Madden appears to be loosely throwing around allegations without any evidence to support his assertions.”

In an interview Tuesday, Nehring told the Williston Herald that he and his client had been ready for the trial.

“Mr. Brewer was innocent of these charges,” he said.

McCreary’s trial on the conspiracy and aggravated assault charges is scheduled for March 9.

Sons of Silence MC members facing charges

Williston, North Dakota, USA (April 26, 2019) BTN — Two members of the Sons of Silence Motorcycle Club are accused of conspiring to commit an assault in late March. Michael Jon McCreary, 52, was charged Wednesday, April 24, with aggravated assault and conspiracy to commit aggravated assault, both class C felonies. Earl Benjamin Brewer, 49, was charged Thursday with conspiracy to commit aggravated assault, a class C felony.

Police say that Brewer paid McCreary $2,000 to attack one of Brewer’s former co-workers.

Officers were called to the 900 block of Energy Street on the morning of March 28 and found a man with a bleeding cut on his head, according to an affidavit of probable cause filed in Northwest District Court. The man told police that at around 7 a.m. that day, he’d heard a knock on his door and saw someone outside he didn’t recognize, so he didn’t answer the door.


He said about two hours later, the same man knocked again, but he still didn’t answer, court records indicate. He saw the man, later identified as McCreary, get into a silver Ford F-150 pickup. Around 9:30 a.m., the man got in his own pickup truck to leave, but when he put it in gear, he heard a loud noise, charging documents state.

He saw the lugnuts had been removed from the front passenger-side wheel, causing the wheel to fall off.

The man told police that he saw McCreary in the same silver F-150 from earlier in the morning parked about 100 yards away and started to walk toward him. McCreary introduced himself as “John Bishop” and the two shook hands, investigators wrote in the probable cause affidavit.

When the man turned around, McCreary hit him in the head with a large wrench, court documents said. The man threw his phone and headphones at McCreary, and McCreary drew a large knife and started to chase him. McCreary shouted “That’s what you get for trying to snitch on work!” as the man ran away, police said. The man told officers he believed the assault was related to a previous job, and that some of his coworkers from that job were associated with the Sons of Silence Motorcycle Club.

A witness saw the assault, police wrote in the charging documents, and a witness also told officers that Brewer paid McCreary $2,000 to make sure the man McCreary assaulted “did not make it to work.” Police were able to review text messages between McCreary and Brewer, who recently became associated with the Sons of Silence, court records state. Brewer is a former coworker of the man who was attacked.

The two charges are the second time this month McCreary has been accused of an assault related to the Sons of Silence. On April 12, he was charged with a class C felony count of aggravated assault after an incident on April 6 at the Grand Williston Hotel.

A man at the hotel told police he’d been working as a security guard when there was a private party that included members of the club. He said he saw McCreary hit another person on the head and stepped in to stop the situation from escalation, according to an affidavit of probable cause.

McCreary, who was wearing a vest with “Sons of Silence” on it, pushed him, and a group of other men in similar vests surrounded him, court records said. The group told him to “Stay out of club business,” the man told investigators. The man said he fell and then McCreary hit him on the head with a foot-long metal flashlight, charging documents indicate.

At a bond hearing Wednesday, Eric Lundberg, assistant state’s attorney for Williams County, said McCreary was accused of committing three assaults on three different people in less than a month. McCreary was charged with a class B misdemeanor count of simple assault on Tuesday, April 23. “The state is very concerned about the danger to the community,” Lundberg said.

Jeremy Curran, McCreary’s defense attorney, said his client had a limited criminal history and had never failed to appear for court. He said McCreary had ties to the community and lived with his wife of 25 years. Northwest District Judge Josh Rustad set McCreary’s bond at $15,000 for both cases. A bond hearing for Brewer had not been scheduled as of Thursday afternoon.

September 4, 1957 - February 24, 2016

James "Dago" Marchellino, a member of the Sons of Silence MC for over 36 years died Tuesday, February 23, 2016 at Mercy Hospital in Des Moines, IA.

Funeral Service for 58 year old James "Dago" Marchellino of Kimballton will be held at 2pm on Saturday, February 27 at the Hausbarn Conference Center in Manning.  Dago passed away on Tuesday, February 23 at Mercy Hospital in Des Moines.  He is survived by his wife, Dale Marchellino of Carroll; 2 daughters:  Jami (Mark) Fite of Baseshore, KS and Megan Marchellino of Iowa City; and his Mother, Dorothy Hansen of Kimballton.

The Ohde Funeral Home in Kimballton is in charge of arrangements.  Friends may call from 10am until time of service on Saturday at the Hausbarn Conference Center in Manning.
